The Ministry of Industry and Information Technology publicly solicited opinions on the "Interim Provisions on the Management of Traceability of Recycling and Utilization of Power Battery for New Energy Vehicles" (Draft for Comment). Article 1 [General Requirements for Management] In accordance with the Interim Measures for the Administration of Recycling and Utilization of Power Battery for New Energy Vehicles (No. 43 of the Ministry of Industry and Information Technology [2018] No. 43), the “National Monitoring Platform for the National Monitoring and Recovery of Power Battery Recycling and Utilization of New Energy Vehicles” was established. (hereinafter referred to as “trace source management platform”), collect information on the whole process of production, sales, use, scrapping, recycling and utilization of power batteries, and monitor the fulfillment of responsibility for recycling of each link.

 

Article 2 [Implementation time of new models] From the date of implementation of these regulations, new energy vehicle products and new mandatory product certifications for newly obtained “Road Motor Vehicle Manufacturing Enterprises and Products Announcement” (hereinafter referred to as “Announcement”) Traceability management of new energy vehicle products (including imported new energy vehicles).

 

Article 3 [In the implementation time of production vehicles] New energy vehicle products (including imported new energy vehicles) that have obtained the "Announcement" and obtained compulsory product certification before the date of implementation of these regulations are subject to traceability management for 12 months.

 

Article 4 [Implementation time of production vehicles] Automobile production enterprises (including importers) shall supplement the relevant traceability information to the new energy automobile products that have been produced and imported but not included in the traceability management within 12 months of the implementation of this regulation, traceability management platform.

 

Article 5 [Implementation time of products used in cascades] from the date of implementation of these regulations, traceability management shall be implemented for the use of battery products for ladders.

 

Article 6 [Code Marking Requirements] The battery production and ladder utilization enterprises shall, in accordance with the “Notice on Opening the Automobile Power Battery Code Recording System” (Zhongji Han [2018] No. 73), carry out the registration of the manufacturer code and the coding rules. The power battery or the ladder produced by the enterprise uses the battery product for coding and identification.

 

Article 7 [Application Procedures and Information Disclosure] Enterprises that purchase, dismantle, disassemble and comprehensively use automobile production and scrapped automobiles shall apply for an account on the traceability management platform (see Appendix 1 and 2 for application materials). Each enterprise should upload traceability information on the traceability management platform (see Appendix 3). The automobile production enterprise shall upload the information of the recycling service outlets on the traceability management platform (see Attachment 4) and publish it to the public on the corporate website.

 

Article 8 [Requirement for Production Information Upload] The automobile production enterprise shall upload within 7 working days after the issuance of the domestic new energy vehicle ex-factory certificate, the importer shall upload within 7 working days after the import of the new energy vehicle is cleared and the inspection and quarantine is completed information.

 

Article 9 [Requirements for the Upload of Sales Information] The seller who cooperates with the automobile production enterprise shall submit the record information to the automobile production enterprise in time after the vehicle is sold, and inform the owner of the vehicle to record the requirements and procedures for updating the record information when the information changes. The automobile manufacturer shall upload the information within 15 working days after the vehicle sales card and the vehicle owner record information are updated.

 

Article 10 [Requirements for the Maintenance Information Upload] Repairers and battery leasing companies that cooperate with automobile production enterprises shall submit information to the automobile production enterprises in time after the maintenance and replacement of the power batteries. The automobile production enterprise shall upload the traceability information within 15 working days after the maintenance and replacement of the power battery.

 

Article 11 [reclaiming information uploading requirements] the recycling service outlets shall submit information to the automobile production enterprises after the recycling and transfer of the used power batteries. Automobile production enterprises shall upload information within 15 working days after the recycling and transfer of used power batteries.

Article 16 [Corporate traceability requirements] Automobile production, battery production, scrap car recycling, and comprehensive utilization enterprises shall establish an internal management system, strengthen traceability management, and ensure traceability information is accurate and true.

 

Article 17 [Local Supervision and Management Requirements] The provincial-level industrial and informatization authorities shall, in conjunction with the relevant departments at the same level, supervise and inspect the performance of the traceability of relevant enterprises in the region.

 

Article 18 [Reference to the definition of terms] The terminology and definitions of the Interim Measures for the Administration of Recycling and Utilization of Power Battery for New Energy Vehicles shall apply to these Provisions.

 

Article 19 [Effective time] These Provisions shall be implemented on August 1, 2018.
